1. Acceptance of Terms

By accessing or using Hektera Ads (ads.hektera.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service. Hektera reserves the right to update these terms at any time; continued use constitutes acceptance.

2. Description of Service

Hektera Ads is a Google Ads campaign management platform with AI that integrates with Slack. The service uses the Google Ads API to enable users to:

• Create new Google Ads campaigns via natural language commands
• Manage existing campaigns including pausing, budgeting, and targeting adjustments
• Generate performance reports and receive AI-powered optimization insights

3. Account Registration and Access

Access to Hektera Ads requires registration and approval. You must provide accurate information during registration. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

You must have a valid Google Ads account and the authority to grant Hektera Ads API access to that account. By granting such access, you represent that you have the right and authority to do so.

4. Google Ads API Compliance

Hektera Ads is built on the Google Ads API. Your use of Hektera Ads is subject to compliance with Google Ads policies and the Google Ads API Terms of Service. You agree not to use Hektera Ads in any way that violates Google's advertising policies, including but not limited to creating campaigns for prohibited content or engaging in deceptive advertising practices.

5. Acceptable Use

You agree not to use Hektera Ads to:

• Violate any applicable laws or regulations
• Create campaigns for products or services prohibited by Google Ads policies
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or attempt to extract the source code of the service
• Resell or sublicense access to the service without written permission from Hektera
• Abuse the Google Ads API in ways that violate Google's API usage policies

6. Fees and Payment

Hektera Ads may be offered on a subscription basis. Pricing details will be provided during the onboarding process. All fees are non-refundable unless otherwise stated. Hektera reserves the right to change pricing with 30 days' written notice.

7. Intellectual Property

The Hektera Ads service, including its design, code, AI models, and content, is owned by Hektera and protected by intellectual property laws. You retain ownership of your Google Ads data and campaign content. You grant Hektera a limited license to access and process your data solely to provide the service.

8. Disclaimers and Limitation of Liability

Hektera Ads is provided “as is” without warranties of any kind. We do not guarantee that AI-generated campaign recommendations will achieve specific advertising results. You are solely responsible for reviewing and approving any campaign changes made through the service.

To the maximum extent permitted by law, Hektera shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including advertising spend outcomes or campaign performance results.

9. Termination

Either party may terminate the service relationship at any time. Upon termination, your access to Hektera Ads will be revoked. You may revoke Google Ads API access independently through your Google Account settings. Hektera may terminate accounts that violate these terms without prior notice.

10. Governing Law

These Terms of Service are governed by applicable law. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.
